Effective Date: April 2nd, 2025
These Terms of Service ("Terms") are entered into by and between Juneja Inc., doing business as Campus Tutor (“Campus Tutor," "we," "our," or "us") and you (user), the individual or entity accessing or using the campustutor.org website, including all associated subdomains (the "Site"), and any related services provided by Campus Tutor (the "Services"). By accessing or using the Site or Services, you acknowledge and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease all access to and use of the Site and Services. This agreement shall govern the use of all pages on the Site and all Services provided therein.
For the purposes of these Terms, the following terms shall have the meanings set forth below:
(a) “User”: Refers to any individual or entity that accesses or uses the Site or Services, including both learners and tutors. You, as the User of the site, will be referred to with second person pronouns such as you, you and yours throughout these Terms.
(b) "Learner": An individual who seeks and utilizes tutoring services through the Site and Services.
(c) "Tutor": An individual who provides tutoring services through the Site and Services.
"Services": Refers to the online tutoring platform, and any related services provided by Campus Tutor through the Site, including but not limited to the ability to connect learners and tutors, facilitate communication, and conduct payments.
(d) "Site": Refers to the website Campustutor.org, including any associated subdomains, and any content, functionality, and services offered through the website.
(e) "Collective Content": Refers to any content, information, materials, or resources provided by Campus Tutor or Users through the Site, including but not limited to profiles, course offerings, communication, and any other data uploaded or shared through the platform.
(f) "Terms" or "Terms of Service": Refers to this agreement between Campus Tutor and the User governing the use of the Site and Services.
(g) "Account": Refers to a User’s profile and registration, which allows access to the Services and any personalized features provided by Campus Tutor.
Campus Tutor operates as an online platform that facilitates the connection between learners seeking tutoring services and Tutors offering such services. Campus Tutor is not a direct provider of tutoring services, nor is it an employer, agent, or representative of any Tutor. Tutors are independent contractors who offer their services directly to learners, and Campus Tutor does not have control over the methods, content, or delivery of tutoring services provided by Tutors.
The relationship between Campus Tutor and Tutors is limited to that of a service provider facilitating access to an online marketplace. Campus Tutor does not employ, supervise, or monitor Tutors and is not responsible for any actions or omissions by tutors in the provision of tutoring services. Tutors are responsible for their own actions and any agreements or arrangements made between Learners and Tutors are not the responsibility of the Site.
Campus Tutor is not responsible for the training or supervision of the Tutors, who are, and shall remain, independent contractors in all respects. In accordance with the mutual agreement of Campus Tutor and the Tutors, the relationship between the Tutors and Campus Tutor is that of an independent contractor, and this relationship shall remain an independent contractor relationship going forward, and all of the terms and conditions herein shall be interpreted in light of that relationship. There is no intention to create an employer-employee relationship between the Tutors and Campus Tutor, and each Tutor agrees that they will not claim to be an employee of Campus Tutor nor will they seek employee benefits from the Company. Campus Tutor does not train or advise Tutors on pedagogy, methodology, or otherwise with respect to the learning and tutoring provided to Learners, and all such tutoring services are and shall remain the sole and exclusive purview of the Tutors, who are and shall remain independent contractors and not employees of Campus Tutor.
As a User of the Site, you acknowledge and agree that Campus Tutor is not a party to any contract, agreement, or arrangement between a tutor and a learner. Campus Tutor does not guarantee the quality, effectiveness, or accuracy of the tutoring services provided by Tutors, nor does it endorse or recommend any specific Tutor.
User expressly acknowledges and agrees that Campus Tutor is not, and shall not be made liable for any claims, damages, or disputes arising from the Services provided by tutors, and any such claims or disputes must be addressed directly between the Learner andTutor. Campus Tutor expressly and irrevocably disclaims any liability arising from the interaction between Learners and Tutors, and the User expressly acknowledges and agrees that any and all use of the Services is done at the User’s own risk.
To access and use the Services provided by Campus Tutor, you must meet the following eligibility requirements:
(a) Minimum Age Requirement: You must be at least 13 years old to use the Services. If you are under 18, you may only use the Services under the supervision of a parent, legal guardian, or authorized school representative, who agrees to be responsible for your use of the Services. You represent and warrant that, if you are under the age of 18, you are accessing the Site under the supervision of such parent, guardian or authorized representative.
(b) Legal Capacity: You represent and warrant that you have the legal capacity to enter into a binding agreement under applicable laws. If you are using the Services on behalf of an institution or entity, you further represent that you have the authority, express or implied, as an agent or otherwise, to bind that institution or entity to these Terms.
(c) Compliance with Laws: You agree to use the Services in compliance with all applicable local, state, national, and international laws, regulations, and educational institution policies.
(d) Account Integrity: Users must provide accurate, complete, and up-to-date information when registering for an account and may not create an account on behalf of someone else without authorization. Campus Tutor reserves the right, in its sole discretion, to suspend or terminate accounts that violate these Terms or contain false, misleading, or incomplete information.
Campus Tutor reserves the right to deny access to the Services, suspend accounts, or terminate any User’s access at its sole discretion if it determines that a User does not.Campus Tutor reserves the right, in its sole but commercially reasonable discretion, to modify, suspend, or discontinue any aspect of the Services at any time with or without notice. We may also introduce new features or remove existing features based on our discretion and the needs of our users. The availability and scope of the Services may vary based on the region, type of service, or specific circumstances.
(a) Account Creation: To access certain features of the Site and Services, you must create an account with Campus Tutor. You agree to provide accurate, complete, and up-to-date information during the registration process and to keep your account information current. You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password, and for all activities that occur under your account, whether or not you authorized the activity.
(b) Account Security: You agree to take all reasonable steps to protect the security of your account and prevent unauthorized access, including by using strong passwords and notifying Campus Tutor immediately if you suspect any unauthorized use of your account. You are responsible for any and all actions taken under your account, whether or not you have authorized them.
(c) Account Responsibilities: You agree to use your account in compliance with all applicable laws and regulations and to refrain from engaging in any conduct that could harm the integrity or functionality of the Site or Services. You are responsible for all interactions with other Users conducted through your account, including any payments, communications, or disputes.
(d) Account Suspension or Termination: Campus Tutor reserves the right to suspend or terminate your account at any time, without notice, for any reason or no reason, for acts including but not limited to: Violation of these Terms or any applicable policies; Engaging in negligent, fraudulent, harmful, or illegal activities; Failure to provide accurate or up-to-date information; Unauthorized use of your account or the Services.
Upon termination or suspension of your account, you may lose access to all or part of the Site and Services, including any content or data associated with your account. You may also be required to settle any outstanding obligations prior to the closure of your account.
(e) Account Termination by You: You may close your account at any time by contacting Campus Tutor support or through the account settings on the Site. After account termination, you may lose access to any data or content associated with your account, and Campus Tutor will have no further obligations to you except as provided by law.(f) User Representations: By creating an account, you represent and warrant that you are legally authorized to do so and that you will not use the account for any unlawful or prohibited purpose.
All content made available through the Campus Tutor platform, including but not limited to text, images, videos, graphics, software, trademarks, and other materials (collectively, "Campus Tutor Content"), is owned by or licensed to Campus Tutor and is protected under applicable copyright, trademark, and intellectual property laws.
Campus Tutor grants Users a limited, revocable, non-exclusive, and non-transferable right to access and use Campus Tutor Content strictly for personal, educational, and non-commercial purposes in connection with the Services. Users may not copy, modify, distribute, sell, publicly display, create derivative works from, or otherwise exploit Campus Tutor Content without prior written permission from Campus Tutor.
Campus Tutor reserves the right to update, modify, or remove any Campus Tutor Content at its sole discretion. Unauthorized use of Campus Tutor Content may result in legal action, including suspension or termination of access to the Services.
For the avoidance of doubt, Campus Tutor Content is not, and shall not be, inclusive of the online tutoring services provided by the Tutors, who are and shall remain independent contractors in all respects. Campus Tutor Content refers solely, exclusively and irrevocably to the text, image, graphics, software, trademarks and other materials owned or licensed directly by Campus Tutor, and the tutoring services provided by contractors through the platform shall remain the exclusive domain of such contractors in perpetuity.
(a) Ownership and Responsibility: As a User, you retain all rights to the content you upload, post, or otherwise make available through the Campus Tutor platform (collectively, “User Content”). However, by uploading or posting User Content, you grant Campus Tutor a worldwide, royalty-free, non-exclusive license to use, display, reproduce, modify, adapt, distribute, and publicly perform such content solely for the purpose of providing the Services. This license allows Campus Tutor to operate, promote, and improve the Site and Services.
(b) Prohibited User Content: You are solely responsible for the User Content you submit to the Site. You agree not to upload, post, or otherwise make available any content that -
- Violates any applicable laws or regulations;
- Infringes upon the intellectual property rights or proprietary rights of others;
- Contains harmful, defamatory, offensive, or discriminatory material (included but not limited to hate speech, bullying, racism, misogyny, and harassment);
- Violates any privacy rights or data protection laws;
- Contains viruses, malware, or other harmful code designed to disrupt or damage the Site or its services.
(c) Campus Tutor’s Right to Monitor and Remove Content: While Campus Tutor does not routinely monitor User Content, we reserve the right, but not the obligation, to review, remove, or block any User Content that we believe, in our sole discretion, violates these Terms, applicable laws, or our content guidelines. Campus Tutor will cooperate with law enforcement authorities to investigate potential violations of applicable laws.
(d) Content Ownership by Campus Tutor: All content provided by Campus Tutor (other than User Content) is owned by Campus Tutor or its licensors and is protected by intellectual property laws. Users do not have the right to copy, modify, distribute, or otherwise use such content except as permitted by the platform.
(e) Indemnification: You agree to indemnify and hold harmless Campus Tutor, its officers, employees, agents, and affiliates from any claims, damages, losses, or expenses arising from your User Content, including any claim that your User Content violates the rights of third parties or applicable laws.
The Campus Tutor platform may contain links to third-party websites, services, or resources that are not owned or controlled by Campus Tutor. These links are provided for convenience only and do not constitute an endorsement, sponsorship, or recommendation by Campus Tutor of the third-party websites or their content.
Campus Tutor has no control over, and assumes no responsibility for, the availability, accuracy, legality, or content of any third-party websites or services. Your access to and use of such third-party websites is solely at your own risk and subject to the terms and conditions and privacy policies of those third parties.
Campus Tutor is not responsible for any damages, losses, or liabilities that may arise from your interactions with third-party websites, including but not limited to transactions, data collection practices, or the reliability of information provided on such sites. Users should review the applicable terms and policies before engaging with any third-party services linked through Campus Tutor.
By accessing or using the Site or Services, you expressly agree not to engage in any of the following prohibited activities:
(a) Intellectual Property Violations: You shall not upload, post, transmit, or otherwise make available any content that infringes upon the intellectual property rights of any third party, including but not limited to copyrights, trademarks, patents, trade secrets, or the right of publicity or privacy.
(b) Violation of Laws and Regulations: You shall not use the Site or Services to engage in any unlawful activities or to facilitate actions that may result in the violation of any applicable laws, statutes, or regulations. This includes but is not limited to engaging in fraudulent, deceptive, or misleading conduct.
(c) Objectionable Content: You shall not submit, post, or transmit any content that is defamatory, obscene, abusive, harassing, discriminatory, or otherwise offensive. This includes content that promotes hate, violence, or illegal activities.
(d) Disruption of Service or Systems: You shall not engage in any activity that disrupts, interferes with, or otherwise negatively impacts the normal operation of the Site or Services. This includes, without limitation, engaging in hacking, introducing viruses, or conducting denial-of-service attacks.
(e) Unauthorized Access or Use: You shall not attempt to gain unauthorized access to any part of the Site, Services, or Campus Tutor’s computer systems. This includes accessing non-public areas of the Site or using automated tools, bots, or similar methods to access or collect data from the Site.
(f) Misuse of Campus Tutor's Intellectual Property: You shall not use Campus Tutor’s trademarks, logos, or any other proprietary information in a manner that is not expressly authorized by Campus Tutor. This includes the unauthorized framing or mirroring of any part of the Site.
(g) Commercial Exploitation Without Authorization: You shall not use the Site or Services for any commercial purposes unless explicitly authorized by Campus Tutor. Unauthorized use includes the solicitation of users for services outside the platform or attempts to profit from content that is not permitted by Campus Tutor.
(h) Impersonation or Misrepresentation: You shall not impersonate any person or entity or misrepresent your affiliation with any individual or organization when using the Site or Services. This includes submitting false or misleading information to Campus Tutor or other users.
(i) Circumventing Site Protections: You shall not attempt to bypass or disable any security features of the Site, including any technological protections, digital rights management systems, or encryption systems that Campus Tutor employs to protect the Site and its content.
(j) Spam and Unsolicited Communications: You shall not send unsolicited, unauthorized, or unlawful communications to users of the Site, including but not limited to spam, chain letters, or other forms of mass communication. Any form of advertising or solicitation that is not explicitly permitted by Campus Tutor is prohibited.
(k) Collection of Personal Information Without Permission: You shall not collect, store, or share personal data from other users of the Site or Services without their explicit consent, except as permitted by applicable laws and the Privacy Policy.
(l) Engaging in Reverse Engineering: You shall not attempt to reverse-engineer, data mine, decompile, disassemble, or otherwise derive the source code or underlying structure of the Site, Services, or any software used in the operation of the Site.
(m) Impairing the User Experience: You shall not engage in any activity that may adversely affect the experience of other users of the Site or Services, such as overloading systems, introducing malware, or sending excessive or disruptive traffic to the Site.
(n) Encouraging Violations: You shall not encourage or enable any other individual or entity to engage in any of the prohibited activities outlined in this section.
(a) Payment Processing: All payments made through the Campus Tutor platform are processed by Stripe, Inc. ("Stripe"), a third-party payment service provider. Campus Tutor does not operate its own payment processing system and does not collect, hold, or disburse funds directly. By using the Services, you acknowledge and agree to be bound by Stripe’s Terms of Service and Privacy Policy, which govern the processing of payments made through the platform. Campus Tutor is not responsible for any errors, delays, or issues arising from Stripe’s payment processing services.
(b) Payment Obligations of Learners: Learners agree to pay all applicable fees for tutoring services as specified at the time of booking. By making a payment, the learner authorizes Stripe to process the transaction on their behalf. Payments are non-refundable except as expressly stated in Campus Tutor’s refund policy or as otherwise required by applicable law.
(c) Tutor Compensation: Tutors will receive compensation for tutoring services rendered, as processed by Stripe. Campus Tutor does not guarantee payment to tutors for any sessions that are disputed, canceled, or otherwise deemed invalid under the platform’s policies. Tutors acknowledge and agree that Campus Tutor is not responsible for withholding or remitting any taxes on their behalf. Tutors are solely responsible for determining their tax obligations and ensuring compliance with applicable tax laws.
(d) Chargebacks and Disputes: In the event of a dispute between a learner and a tutor regarding a payment, session completion, or service quality, Campus Tutor reserves the right to review the claim and make a final determination based on the available evidence. Campus Tutor’s decision regarding any dispute shall be final and binding on all parties. Tutors are strongly advised to maintain accurate and detailed records of all tutoring sessions, including communications, session notes, and any other relevant documentation that may help substantiate their claims in the event of a dispute. Failure to provide sufficient supporting evidence may result in a decision unfavorable to the tutor. If a learner initiates a chargeback through their payment provider, Campus Tutor and Stripe will review the claim in accordance with their respective policies. Campus Tutor may request additional information from the involved parties to facilitate dispute resolution. If a chargeback is upheld in favor of the learner, the tutor may forfeit the disputed payment, and Campus Tutor reserves the right to deduct the amount from future payouts or take other remedial actions as necessary. Campus Tutor also reserves the right to suspend or terminate any user’s account if they engage in fraudulent disputes, excessive chargebacks, or any behavior that undermines the integrity of the platform’s payment system.
(e) No Guarantee of Payments: Campus Tutor does not guarantee the timeliness or security of payments processed through Stripe and disclaims all liability for any delays, errors, or losses incurred as a result of payment processing. Users acknowledge that all transactions are facilitated by Stripe and that Campus Tutor has no control over the processing of payments, including but not limited to failed transactions, delays in payouts, or withholding of funds by Stripe.
You acknowledge and agree that as a Tutor or User providing services through Campus Tutor, you are solely responsible for determining your own tax reporting requirements and for the payment of any taxes on income received (including, but not limited to, Tutor Payments) or any other taxes applicable to such income ("Taxes"). You are also solely responsible for reporting any income received for services performed in connection with these Terms of Service, the Services, or the Site, to all relevant government agencies having jurisdiction.
Campus Tutor does not provide tax advice and is not responsible for any tax liabilities or for advising you on how to handle your taxes. You agree that it is your sole responsibility to determine and comply with any tax obligations you may have, including paying income tax, self-employment tax, VAT, or any other taxes, based on the jurisdiction(s) in which you operate.
Furthermore, you agree to indemnify and hold Campus Tutor harmless from and against any and all claims, charges, penalties, or demands related to the payment of Taxes or any other governmental or regulatory requirements. This includes, without limitation, any claims or demands made by tax authorities such as the Internal Revenue Service (IRS), regarding income earned by you in connection with the Services provided through Campus Tutor.
You agree that Campus Tutor is not liable for any taxes, penalties, or other liabilities that may arise from your failure to comply with tax laws or any other relevant legal obligations. Campus Tutor is also not responsible for any claims, charges, penalties, or demands arising from employment insurance, social security programs, or any other public pension program, whether on your behalf or any other party’s behalf, under applicable law.
By using the Site and engaging with the Services, you confirm that you understand your tax obligations as an independent contractor and will comply with all applicable tax laws.
By using the Site and Services provided by Campus Tutor, you agree to maintain the confidentiality of all proprietary, confidential, or sensitive information ("Confidential Information") that you may receive or have access to during your interactions with the Site, Services, or other Users. This includes, but is not limited to, any personal information, business strategies, educational materials, course content, communication between Users, and any other information marked or otherwise identified as confidential.
(a) Obligations of Confidentiality: You agree that, except as expressly authorized by Campus Tutor or required by law, you will not disclose, distribute, share, or use any Confidential Information for any purpose other than as necessary to provide or receive tutoring services through the Campus Tutor platform. This obligation remains in effect both during and after your use of the Site and Services.
(b) Prohibited Disclosure: You agree not to disclose any Confidential Information to any third party without the prior written consent of Campus Tutor or the relevant User to whom the Confidential Information pertains, unless required by law or as otherwise expressly permitted by these Terms.
(c) Security Measures: Both Campus Tutor and the Users agree to take all reasonable steps to protect and secure Confidential Information. Campus Tutor will implement appropriate technical and organizational measures to safeguard any personal data collected from Users in accordance with applicable data protection laws.
(d) Exceptions:
The confidentiality obligations outlined above do not apply to information that -
- Was already known to the receiving party prior to disclosure.
- Is or becomes publicly available through no fault of the receiving party.
- Was independently developed by the receiving party without reference to or reliance on the Confidential Information.
- Is disclosed with the prior written consent of the party who owns the Confidential Information.
(e) Disclosure Required by Law: If you are required to disclose Confidential Information by law or a valid court order, you must promptly notify Campus Tutor, or the relevant party, so that they may take appropriate action to protect the Confidential Information.
(f) End of Agreement: Upon the termination or expiration of your account or the relationship with Campus Tutor, you agree to immediately cease using and return or destroy any Confidential Information in your possession, as directed by Campus Tutor.
Campus Tutor provides the Site and Services "as is" and "as available" without any warranties or representations, either express or implied, regarding the accuracy, reliability, or suitability of the Site or Services for your intended purposes. To the fullest extent permitted by applicable law, Campus Tutor disclaims all warranties, whether express, implied, or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
(a) No Guarantee of Results: Campus Tutor does not guarantee any specific results from your use of the Site or Services, including but not limited to academic success, achievement of learning objectives, or satisfactory tutoring outcomes. Any interactions between Learners and Tutors, including tutoring sessions, are conducted at the sole risk of the Users involved.
(b) Availability and Functionality: Campus Tutor does not warrant that the Site or Services will be available at all times, uninterrupted, or free of errors. The Site and Services may be temporarily unavailable due to maintenance, server issues, or other unforeseen circumstances. Campus Tutor is not responsible for any downtime, service interruptions, or technical difficulties, and does not guarantee continuous, error-free access to the Site.
(c) Content Accuracy: Campus Tutor does not guarantee the accuracy, completeness, or reliability of any content provided by Users, including tutor profiles, course materials, feedback, or other information on the Site. Users are solely responsible for verifying the accuracy and appropriateness of any content they engage with or rely upon.
(d) Third-Party Services: The Site may contain links or references to third-party websites, applications, or services that are not operated or controlled by Campus Tutor. Campus Tutor does not endorse or assume any responsibility for any third-party services, content, or practices. You acknowledge that your use of any third-party services is at your own risk, and Campus Tutor disclaims any liability arising from such use.
(e) No Liability for Loss or Damage: To the fullest extent permitted by law, Campus Tutor shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Site or Services, even if Campus Tutor has been advised of the possibility of such damages. This applies to all claims, whether based on contract, tort, or any other legal theory.
(f) Indemnity: You agree to indemnify, defend, and hold harmless Campus Tutor, its officers, employees, agents, affiliates, and licensors from any claim, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of your use of the Site or Services, your violation of these Terms, or any violation of applicable law or regulation by you or other Users with whom you interact. You agree that the Company shall be able to select its own legal counsel and may participate in its own defense, if it wishes.
To the fullest extent permitted by applicable law, Campus Tutor shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages of any kind, or any loss of profits, revenue, data, or goodwill, whether in contract, tort (including negligence), or any other legal theory, arising out of or in connection with:
(a) Your Use of the Site and Services: Campus Tutor shall not be liable for any damages resulting from your use of, or inability to use, the Site, the Services, or any content available on the Site, including any issues arising from any technical failures, interruptions, delays, or errors in transmitting or receiving information.
(b) Interactions Between Users: Campus Tutor is not responsible, and you hereby acknowledge and agree that Campus Tutor shall not be made liable, for any disputes, disagreements, or damages resulting from interactions between Learners, Tutors, or other users of the Site. Any interactions, including the exchange of services, content, payments, or communication, are at the sole risk of the users involved. Campus Tutor is not a party to these interactions and does not guarantee any outcomes or results from these interactions.
(c) Content Provided by Users: Campus Tutor is not responsible for any content posted, shared, or transmitted by users, including but not limited to tutor profiles, educational materials, feedback, or communications. We do not warrant the accuracy, completeness, legality, or appropriateness of any such content, and we disclaim any liability for any damages resulting from reliance on or engagement with such content.
(d) Third-Party Services or Content: The Site may contain links to or integrations with third-party websites, services, or applications. Campus Tutor does not endorse, control, or assume responsibility for any third-party content or services. Any damages, claims, or losses arising from the use of third-party services are solely your responsibility, and Campus Tutor disclaims any liability in this regard.
(e) Loss or Corruption of Data: Campus Tutor is not responsible for any loss, corruption, or failure to store any content, data, or materials transmitted through the Site or Services. You acknowledge and agree that you are solely responsible for maintaining copies of your content and data.
(f) Maximum Liability: In any case where liability cannot be excluded, Campus Tutor’s total liability to you, whether in contract, tort (including negligence), or otherwise, shall be limited to the amount you paid to Campus Tutor in the three (3) months immediately preceding the event giving rise to the claim, or, if no such payment was made, $50 USD.
(a) Agreement to Arbitrate: By using the Site or the Services, you agree that any dispute, claim, or controversy arising out of or in connection with these Terms, your use of the Site, or your interactions with other users (including but not limited to disputes regarding payments, content, services, and any other disputes arising from the platform) shall be resolved exclusively through binding arbitration, rather than in court. This agreement to arbitrate is intended to be broadly interpreted and applies to all disputes, regardless of whether they relate to contractual, statutory, tort, or other claims.
(b) Arbitration Process: Arbitration shall be conducted by a neutral arbitrator in accordance with the applicable rules of the American Arbitration Association (AAA) or any other arbitration body mutually agreed upon by both parties. The arbitration shall take place in Denton County, Texas unless otherwise agreed upon by the parties. The arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
(c) Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis, and not in a class, consolidated, or representative action. By agreeing to these Terms, you waive any right to participate in any class action lawsuit, class-wide arbitration, or any other proceeding in which someone acts in a representative capacity.
(d) Informal Resolution: Before resorting to arbitration, you agree to first attempt to resolve the dispute informally by contacting Campus Tutor via email at support@campustutor.org. We will work with you in good faith to resolve any issues or concerns. If informal resolution is not successful, either party may initiate arbitration pursuant to the terms and conditions above.
(e) Exclusion of Certain Claims: Notwithstanding the above, either party may seek injunctive relief or other equitable remedies in a court of competent jurisdiction for any breach of intellectual property rights or any other violation of the Terms that may cause irreparable harm.
(f) Costs and Fees: Each party shall bear its own costs of arbitration, including attorneys' fees, except that the prevailing party in any arbitration may be entitled to recover reasonable attorneys' fees as awarded by the arbitrator in accordance with applicable law.
(g) Severability: If any part of this Dispute Resolution section is found to be unenforceable, the remainder of the section will remain in effect. If the prohibition on class actions is found to be unenforceable, then the entirety of this Dispute Resolution section shall be void, and the dispute will be resolved in a court of competent jurisdiction.
(a) Non-Solicitation of Users: You agree that, during your use of the Site and for a period of 12 months following the termination of your access to the Site or Services, you will not directly or indirectly solicit, hire, or attempt to hire any other users (including Tutors or Learners) of Campus Tutor for any services that are similar to the Services provided on the Site, without the prior written consent of Campus Tutor. This includes, but is not limited to, hiring or engaging Users for personal tutoring or other educational services outside the Campus Tutor platform.
(b) Non-Solicitation of Employees and Contractors: You further agree not to solicit, hire, or attempt to hire any employees, contractors, or affiliates of Campus Tutor, during your use of the Site and for a period of 12 months following the termination of your access to the Site or Services, for any services or activities that are competitive with Campus Tutor’s business, including but not limited to tutoring, educational consulting, or other online platform services.
(c) Enforcement: You acknowledge and agree that any breach of this Non-Solicitation section could cause Campus Tutor significant harm, for which monetary damages may be an insufficient remedy. Therefore, Campus Tutor reserves the right to seek injunctive relief or other equitable remedies to enforce this section, in addition to any other legal remedies available under applicable law.
(d) Exceptions: This section does not prohibit you from engaging in any professional relationship with users or employees of Campus Tutor once they have ceased their affiliation with the Site or if they have independently approached you for services unrelated to the Campus Tutor platform.
These Terms, and any dispute or claim arising out of or related to them, the Site, or the Services, shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
If any dispute is not subject to arbitration as outlined in the Dispute Resolution section, such dispute shall be resolved exclusively in the courts of Denton County, Texas, or the United States District Court for the Eastern District of Texas, and you consent to the personal jurisdiction of such courts for that purpose.
You may not assign, transfer, or delegate your rights or obligations under these Terms without prior written consent from Campus Tutor. Any attempted assignment or transfer in violation of this provision shall be null and void.
Campus Tutor reserves the right to assign or transfer its rights and obligations under these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law. These Terms shall be binding upon and inure to the benefit of the parties, their successors, and permitted assigns.
Campus Tutor values and encourages feedback from our users to continuously improve our platform and services. By submitting any feedback, suggestions, ideas, or recommendations, you acknowledge that Campus Tutor has the right to use, implement, modify, and distribute such feedback without any obligation to provide compensation, credit, or acknowledgment.
You further agree that any feedback you provide is voluntary and does not create any contractual or legal obligations on the part of Campus Tutor. Additionally, we request that you do not submit any confidential or proprietary information, as Campus Tutor assumes no responsibility for maintaining the confidentiality of unsolicited feedback.

Campus Tutor reserves the right to modify, update, or revise these Terms of Service at any time at our sole discretion. Any changes will become effective upon posting on our website or as otherwise communicated to you. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.
If we make material changes that significantly affect your rights or obligations, we may provide additional notice, such as by email or through an in-platform notification. It is your responsibility to review these Terms periodically to stay informed of any updates.
If you do not agree to the updated Terms, you must discontinue your use of the Services.
